Earlier this week, California signed two bills into law, making it the third state after Maryland and Illinois, to prohibit businesses and schools from demanding applicants’ social media login information.
AB-1844, which governs employers, contains an exception that allows an employer to request employees to divulge personal social media information when it’s relevant to a workplace investigation involving employee misconduct or a legal violation. The new law does not apply to passwords or information used on employer-issued electronic devices. Both laws will go into effect on January 1, 2013.
