Valawyersweekly.com is hosting Judge Hogshire’s order that explains Murray and Lester’s sanctionable actions.  Judge Hogshire identifies the following:

  • Murray instructing Lester to “clean up” his facebook page by deleting pictures after seeing a picture of Lester “clutching a beer can” in the company of “other young adults” wearing a shirt that reads “I <3 hot moms.”
  • Murray’s failure to disclose a longstanding relationship with a jury foreperson;
  • Murrary’s intemperate behavior at trial including invoking God and prayer, as well as crying during open and closing argument to the jury;
  • Murray’s violation of the Court’s pre-trial ruling that barred mentioning Defense’s original assertion that Lester was comparatively negligent;
  • Murray’s production of sympathy inducing testimony;
  • Lester’s deactivating his facebook account and claiming he did not have one in a misleading response to Defendant’s discovery request;
  • Lester’s deleting of facebook photos;
  • Lester’s misrepresentations in a deposition that he never deactivated or deleted his facebook page;
  • Lester’s claims on the stand at trial that he never deleted facebook photos, despite previously admitting the same;
  • Lester’s misrepresentations that he was volunteering for the Boys and Girls club.
